Welcome to nicobedon.com, the official digital platform of elite CrossFit athlete Nicolas Bedon, offering world-class online coaching, programs, and app-based fitness solutions. These Terms and Conditions ("Terms") govern your access to and use of our website, mobile app, and services. By accessing or using any part of our platform, you agree to be bound by these Terms. If you do not agree, please discontinue use immediately.
1. Eligibility and Use of This Site
1.1 You must be 18 years of age or older, or have explicit permission from a parent or legal guardian, to use our platform.
1.2 You agree to use this website and its services lawfully and in accordance with these Terms.
1.3 You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Notify us immediately if you suspect any unauthorised use.
2. Health Disclaimer
2.1 All fitness, training, and nutrition content provided through our platform is intended for informational and coaching purposes only. We are not a medical organisation and do not provide medical advice, diagnosis, or treatment.
2.2 You should always consult a licensed physician or qualified healthcare professional before beginning any new exercise or nutrition program, particularly if you have pre-existing health conditions, injuries, or are pregnant.
2.3 Participation in our programs is entirely at your own risk.
3. Personal Responsibility
3.1 You acknowledge that your results from any training program depend on your personal effort, consistency, adherence, and individual health status.
3.2 We do not guarantee specific outcomes. We are not liable for any injuries, illness, or results — or lack thereof — arising from following our programs.
4. Coaching Services
4.1 Coaching and training plans provided by Nicolas Bedon or True South Strength are personalised for athletic performance purposes and are not medical or therapeutic in nature.
4.2 We reserve the right to modify, adjust, or update program structures and offerings at any time to ensure the best possible experience for our members.
5. Memberships, Billing and Trials
5.1 Subscription plans are offered on a monthly basis. All prices are listed in USD.
5.2 By subscribing, you authorise automatic recurring billing until you cancel. Payment will be charged to your selected payment method at the beginning of each billing cycle.
5.3 Plans may be cancelled at any time by emailing help@nicobedon.com. Refunds are not issued for unused time within a billing period unless required by applicable law.
5.4 Upon enrolment, the duration of your training program will be agreed upon during the onboarding process between you and your assigned coach.
5.5 During the agreed timeframe, you will retain guaranteed access to your assigned program, coaching services, and training platform.
5.6 If no fixed duration is established during onboarding, access will continue on a rolling monthly basis until you request cancellation.
5.7 Requests to pause access during an active program are subject to the Membership Pause Policy outlined in Section 6.
6. Membership Pause Policy
6.1 Eligible members on monthly plans may request a pause under the following circumstances:
- Medical issues or injury
- Maternity leave
- Travel
- Financial hardship
6.2 Pause terms:
- Minimum pause duration: 4 weeks
- Maximum pause duration: 16 weeks per calendar year
- Requests must be submitted via email to help@nicobedon.com at least 2 business days before your next billing cycle
- Access to programs and the training app will be suspended during the pause period
- No charges will be made during an approved pause
- Cancellation is not permitted while a pause is active
6.3 All pause requests are subject to review and approval by the nicobedon.com team.
7. Technology and Access
7.1 We do not guarantee uninterrupted, error-free access to our website or app at all times. We are not liable for downtime caused by technical issues, maintenance, or third-party service failures.
7.2 Some content or features may not be available on all devices or browsers.
8. Intellectual Property
8.1 All materials on this platform — including but not limited to logos, branding, workout programs, videos, documents, and training plans — are the intellectual property of Nicolas Bedon and True South Strength LLC.
8.2 You may not copy, reproduce, distribute, publish, or create derivative works from any content on this platform without explicit written permission from us.
9. Risk Warning
9.1 By participating in our programs, you acknowledge the inherent risks associated with physical exercise, including but not limited to:
- Soft tissue injuries (muscles, ligaments, tendons)
- Joint and bone injuries
- Cardiac or respiratory complications
- Slips, falls, or overexertion
- Aggravation of prior injuries or conditions
9.2 You are solely responsible for choosing a safe training environment and for pacing your efforts appropriately.
9.3 We are not liable for adverse outcomes resulting from failure to disclose food allergies, pre-existing medical conditions, or non-compliance with medical advice.
10. User Conduct
10.1 You agree not to engage in defamatory, abusive, hateful, discriminatory, harassing, or unlawful behaviour toward coaches, staff, or other members of our community.
10.2 We reserve the right to suspend or permanently remove access from any user who violates these Terms or our community standards, without prior notice or refund.
11. Complaints
11.1 All complaints must be submitted to help@nicobedon.com with the subject line "Complaint" and should include:
- A detailed explanation of the issue
- Any supporting documentation where applicable
11.2 We aim to review and respond to all complaints within 14 business days.
12. Limitation of Liability
To the fullest extent permitted by applicable law:
12.1 We disclaim all implied warranties and representations. We are not responsible for:
- Losses arising from your own negligence or misuse of our services
- Failures of third-party services or integrations
- Downtime or technical issues with our website or app
- Personal injury, death, or property damage arising from participation in our programs
12.2 You accept that results are not guaranteed and that participation in our services is entirely at your own discretion and risk.
13. Indemnification
13.1 You agree to indemnify, defend, and hold harmless Nicolas Bedon, True South Strength LLC, and their associated coaches, contractors, and employees from and against any claims, damages, losses, costs, and legal fees arising from:
- Your use of our website, app, or services
- Any breach of these Terms
- Misuse of platform materials or communications
- Harmful or unlawful behaviour directed at others through our platform
14. Communications
14.1 By creating an account or signing up for our services, you consent to receive emails from us related to your membership, program updates, and promotional offers. You may opt out of marketing communications at any time by clicking the unsubscribe link in any email.
14.2 Official notices from us may be sent by:
- Email to your registered account address
- Written communication to your billing address on file
15. Assignment
15.1 We reserve the right to transfer, assign, or delegate ownership or operational responsibility of this website, app, or services to another business entity without prior notice to you. Your rights and obligations under these Terms will remain unaffected.
16. Severability
16.1 If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be modified to the minimum extent necessary, and the remaining Terms will continue in full force and effect.
17. Entire Agreement
17.1 These Terms constitute the entire agreement between you and nicobedon.com regarding your use of our services and supersede all prior communications, representations, or agreements, whether written or oral.
18. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of New Jersey, United States. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in New Jersey.
