Client Waiver, Assumption of Risk & Release of Liability

By submitting this form, you (the "Client") acknowledge and agree to the following terms:

References to "Nico Bedon" or "Coach" in this Waiver refer to Nicolas Bedon-Delosrios, a/k/a Nicolas Bedon, doing business as "Nico Bedon."

Opt-In 1 — Assumption of Risk

I acknowledge and accept the following risks:

I acknowledge that participation in fitness activities — including strength training, conditioning, aerobic exercise, and mobility work — whether at home, outdoors, or in a gym, carries risks of injury or illness. I knowingly assume all such risks, including but not limited to:
  • Sprains, strains, and broken bones
  • Heart complications or respiratory issues
  • Injuries caused by improper use of equipment
  • Aggravation of pre-existing conditions
  • Accidents due to my environment or surroundings

Opt-In 2 — Medical Clearance

I confirm that:

  • I am physically and mentally capable of participating in this fitness program
  • I have consulted with a medical professional or have chosen to participate without such consultation, at my own risk
  • I will immediately inform Nico Bedon of any changes to my health status

Opt-In 3 — Release of Liability

I release and discharge Nico Bedon from all liability:

I release, waive, and discharge Nico Bedon (Coach), any associated business entities, employees, or agents from any and all liability, claims, demands, or causes of action arising out of or related to any injury, loss, or damage I may sustain through participation in the coaching program. This includes, without limitation, claims arising from:
  • Negligence (excluding gross negligence or willful misconduct)
  • Use or misuse of training advice or resources
  • Technical failures in the TrueCoach platform
  • Self-directed execution of exercises outside of Coach supervision

Opt-In 4 — Governing Law & Venue

I agree to the following governing law and venue terms:

This Waiver, and any dispute arising from or relating to my participation in Nico Bedon's coaching program, shall be governed by the laws of the State of Tennessee, without regard to its conflict of law provisions. I agree that any legal action or proceeding arising out of this Waiver shall be brought exclusively in the state or federal courts located in Tennessee, and I consent to the personal jurisdiction of those courts.

Opt-In 5 — Indemnification

I agree to indemnify and hold harmless:

I agree to indemnify, defend, and hold harmless Nico Bedon (Coach), and any associated business entities, employees, or agents, from and against any claims, damages, losses, or expenses (including reasonable attorneys' fees) brought by any third party — including but not limited to family members, dependents, or other individuals — arising out of or related to my participation in the coaching program.
